Terms of Service Agreement

The terms, conditions, and guidelines associated with the use of the services (the "Services") provided by Mattawan Family Dentistry are set forth in this Terms of Service Agreement ("TOS"). Please read this TOS carefully before you use the Services. By using the Services, you ("you" or "your," as appropriate) agree to abide by the terms, conditions, and guidelines set forth in this TOS.

Changes to Terms

Please note that Mattawan Family Dentistry may update or change this TOS from time to time without notice. USE OF THE SERVICES AFTER SUCH CHANGES HAVE TAKEN EFFECT CONSTITUTES ACCEPTANCE OF ALL CHANGES.

Please also note that if Mattawan Family Dentistry determines at any time that you have abused or violated any of these terms, conditions, and guidelines, Mattawan Family Dentistry reserves the right to terminate the Services immediately without notice.

User Eligibility

You must be at least 18 years old or have the consent of a legal guardian to use the Services. If you are under 18, you must have a parent or legal guardian contact us to schedule appointments on your behalf.

Links to Third-Party Sites

Some of the links on our website (the "Site") will allow you to leave the Site. Third-party sites to which the Site may link ("Third-Party Linked Sites") are not in any way under Mattawan Family Dentistry's control, and Mattawan Family Dentistry DOES NOT ASSUME ANY RESPONSIBILITY OR LIABILITY FOR ANY INFORMATION, CONTENT, COMMUNICATIONS, SERVICES, GOODS, OR OTHER MATERIALS AVAILABLE ON SUCH THIRD-PARTY LINKED SITES OR FOR ANY CHANGES OR UPDATES TO SUCH SITES. License to Mattawan Family Dentistry

By posting messages, uploading files, inputting data, or engaging in any other form of communication through the Services, you are granting Mattawan Family Dentistry a royalty-free, perpetual, non-exclusive, unrestricted, transferable, worldwide license to:

  • Use, copy, adapt, transmit, retransmit, distribute, create derivative works of, and/or publicly or digitally perform or display any such communication.

  • Sublicense to third parties the unrestricted right to exercise any of the foregoing rights granted with respect to the communication.

The foregoing grants shall include the right to exploit any proprietary rights in such communication, including but not limited to rights under copyright, trademark, or patent laws.

Appointment Scheduling

By using our online appointment scheduling process, you understand and agree to the following:

  • The information you provide during the course of scheduling an appointment through our webpage will be saved to you or your family’s account with Mattawan Family Dentistry.

  • If you are under eighteen, you will need to call Mattawan Family Dentistry to schedule an appointment, rather than use the online scheduling process.

  • If you schedule an appointment for a minor (under eighteen years old), Mattawan Family Dentistry must validate your legal guardian or parental status at the time of the appointment.

  • To the extent you need to reschedule or cancel your appointment, or you have a dental emergency, you will need to call Mattawan Family Dentistry directly.

  • You agree to receive e-mail and text message confirmations of your scheduled appointment.

Payment Terms and Billing

All payments for dental services must be made in accordance with the rates provided during the appointment booking process. Refunds are subject to our cancellation and refund policy, which is available upon request.

Force Majeure

Mattawan Family Dentistry will not be held responsible for any delay or failure to perform due to causes beyond our reasonable control, including but not limited to natural disasters, power failures, or internet disruptions.

Prohibited Uses

Users agree to use the Services only for lawful purposes, such as scheduling appointments, accessing educational materials, or communicating with our team. Activities must comply with all local, state, national, and international laws and regulations applicable to your use of the Services. Use of the Services for unlawful or unauthorized purposes is strictly prohibited. Prohibited activities include but are not limited to:

  • Harassing, threatening, or defaming others.

  • Distributing viruses, worms, or other harmful software.

  • Engaging in spamming or other unsolicited communications.

  • Posting any material that infringes on the intellectual property rights of others.

Termination

Mattawan Family Dentistry may terminate the Services and access to this Site at any time without notice in its sole discretion. In the event of a termination, the disclaimers and limitations of liability set forth in this TOS shall survive.

Trademarks and Copyright

The trademarks, logos, and service marks displayed on the Site are the property of Mattawan Family Dentistry. You may not use any of these without prior written permission. All materials on the Site are copyrighted and protected under applicable law.

General Terms

If any provision of this TOS is found to be invalid or unenforceable, such provision will be modified to the minimum extent necessary to make it valid and enforceable. If modification is not possible, the provision will be deemed severed, and the remaining provisions shall remain in full force and effect. This TOS constitutes the entire agreement between you and Mattawan Family Dentistry regarding the use of the Site and Services.

Indemnification

You agree to indemnify and hold harmless Mattawan Family Dentistry, its officers, employees, agents, and representatives from any claim, demand, or action arising out of your use of the Services, including any breach of these Terms of Service.

Dispute Resolution

Any dispute arising out of or relating to these Terms of Service or the use of the Services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration will take place in the state of Michigan, and the arbitration decision will be final and binding.

Account Responsibility

You are responsible for maintaining the confidentiality of your account and any activities that occur under your account. You agree to notify Mattawan Family Dentistry immediately of any unauthorized use or suspected breach of security.

Health and Safety Disclaimer

You acknowledge that certain dental procedures carry inherent risks. Mattawan Family Dentistry will provide all relevant information about these risks and obtain informed consent before any treatment is performed. By scheduling and attending appointments, you consent to receiving dental treatments in accordance with our standard practices and policies.

User-Generated Content

By submitting reviews, comments, or other content to the Site, you grant Mattawan Family Dentistry the right to use, modify, and display such content, including for promotional purposes. We reserve the right to remove any content that we deem inappropriate, offensive, or in violation of these Terms of Service.

Jurisdiction and Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the State of Michigan. Any legal action or proceeding under this Agreement shall be brought in the courts located in Michigan, and you consent to the jurisdiction of such courts.
